Terms of Service
Effective: June 16, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and Tsuyu ("Tsuyu," "we," "us," or "our"), operator of the service available at tsuyu.io and related subdomains (collectively, the "Service"). By creating an account, accessing the Service, or generating a video with Tsuyu, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You may use Tsuyu only if all of the following are true:
- You are at least 13 years old. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
- You are not currently banned, suspended, or otherwise prohibited from using YouTube, TikTok, Instagram, Reddit, Stripe, or any other platform that Tsuyu integrates with for publishing, payments, or source material.
- You are not located in a country subject to a United States embargo, and you are not on any U.S. government list of restricted or prohibited parties.
- You have the legal capacity to enter into a contract.
We may refuse service, close accounts, or remove content at our discretion if we reasonably believe you do not meet these eligibility criteria.
3. Account Registration and Security
To use most features of Tsuyu you must register for an account. You agree to provide accurate, current, and complete information during registration, and to keep that information up to date.
You are solely responsible for:
- Keeping your password and any API keys or OAuth tokens issued to you confidential.
- All activity that occurs under your account, whether or not you authorized it.
- Notifying us promptly at [email protected] if you suspect your account has been accessed without your permission.
One person or legal entity may maintain only one free account. Creating duplicate accounts to circumvent quotas or suspensions is a material breach of these Terms.
4. Subscription Plans and Billing
Tsuyu offers a Free plan and paid subscription plans ("Starter" and "Pro"). Features and quotas for each plan are described on our pricing page and may change from time to time. Any material reduction in features or quotas applied to an active paid plan will be communicated in advance and will take effect only at the start of your next billing cycle.
Billing. Paid plans are billed in advance through Stripe on either a monthly or yearly cadence, as selected at checkout. By subscribing, you authorize Tsuyu and Stripe to charge your payment method on a recurring basis until you cancel.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price for your plan. You can disable auto-renewal at any time from your Settings page; cancellation takes effect at the end of your current billing period, and you retain access through that period.
Refunds. Monthly subscriptions are non-refundable. For yearly subscriptions, we offer a 14-day refund window only for your first yearly purchase: if you request a refund within 14 days of that first yearly charge by emailing [email protected], we will issue a full refund and cancel your subscription. Renewals of yearly subscriptions, upgrades, and any subsequent yearly purchases are not eligible for this refund window. Quotas consumed during a billing period do not carry over and are not refundable on a prorated basis.
Taxes. All fees are exclusive of applicable sales tax, VAT, or similar taxes, which will be added where we are required to collect them.
Failed payments. If a charge fails, we will attempt to retry through Stripe. If we cannot collect after a reasonable period, we may downgrade your account to the Free plan and restrict access to paid features.
5. User-Submitted Content
"User Content" means any text, scripts, prompts, audio, images, files, URLs, Reddit post references, YouTube links, or other material you submit, upload, or provide to the Service, and any videos, thumbnails, captions, or other outputs generated at your direction.
Your ownership. As between you and Tsuyu, you retain all rights you have in your User Content. Tsuyu does not claim ownership of your scripts, source material, creative choices, or finished videos.
License to Tsuyu. You grant Tsuyu a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, transcode, modify, and create derivative works of your User Content solely as necessary to: (a) operate, maintain, and improve the Service; (b) render and deliver the videos you request; (c) publish to third-party platforms you have connected; and (d) enforce these Terms and comply with law. This license ends when you delete the content or close your account, except where retention is required to comply with a legal obligation or to resolve an active dispute.
Storage. Generated videos and source assets are stored on Cloudflare R2; account and metadata are stored in our PostgreSQL database. We retain your content only for as long as your account is active or as described in Section 11 (Termination).
6. Content You Don't Own
This section is critical. Please read it carefully.
Tsuyu lets you pull source material from Reddit posts, YouTube videos, arbitrary URLs, and uploaded files. Tsuyu is a tool, not a publisher or a licensing service. We do not pre-clear, review, or indemnify the copyright, trademark, right-of-publicity, privacy, or platform-policy status of the material you choose to feed into the Service.
Your representations. Each time you submit third-party material to Tsuyu or generate a video that incorporates it, you represent and warrant that:
- You own the material, or you have all necessary licenses, permissions, consents, and rights to use it in the manner you are using it (including to create derivative works and to publish them on the platforms you have connected).
- Your use of the material does not infringe the intellectual property, privacy, publicity, or contractual rights of any third party.
- Your use complies with the terms of the source platform โ including, without limitation, Reddit's Data API Terms, YouTube's Terms of Service, and TikTok's Community Guidelines โ and that you will provide any attribution those platforms require.
- Your use complies with any applicable fair use, fair dealing, or similar doctrine in your jurisdiction.
DMCA and takedowns. If a rights holder notifies us of infringement, we will respond in accordance with the Digital Millennium Copyright Act (17 U.S.C. ยง 512) and comparable laws. We may remove content, disable your account, and pass the notice on to you. Send DMCA notices to [email protected] with "DMCA" in the subject line.
Allocation of responsibility. Responsibility for the copyright status, defamation risk, and platform-policy compliance of anything you generate with Tsuyu rests entirely with you. Tsuyu will not defend or indemnify you against claims arising from your choice of source material.
7. AI-Generated Content Disclosure
Tsuyu generates videos using AI tools including Anthropic Claude (script analysis), OpenAI and ElevenLabs (text-to-speech), and Replicate (thumbnail generation). The output is synthetic or materially altered by AI.
Many platforms โ including YouTube, TikTok, and Meta โ require creators to disclose when content is synthetic, AI-generated, or materially altered, particularly when the content depicts realistic-looking people, places, or events. You are responsible for making those disclosures on every platform where you publish.
When you publish to YouTube through Tsuyu, Tsuyu will pass the altered_or_synthetic flag on the upload based on your selection. Setting this flag truthfully, and making any additional labels, disclosures, or descriptions that a platform requires, is your responsibility. Tsuyu does not monitor your publications for disclosure compliance.
AI outputs may contain errors, hallucinations, or fabricated statements of fact. You are responsible for reviewing generated videos before publishing.
8. Third-Party Platform Integrations
Tsuyu can connect to YouTube, TikTok, and Instagram via OAuth, as well as to source platforms such as Reddit. When you connect an account, you authorize Tsuyu to access that account and to take actions โ uploading videos, publishing posts, reading posts you select, managing metadata โ on your behalf, within the scopes you granted.
By connecting a third-party account you also agree to that platform's terms, including YouTube's Terms of Service and API Services Terms, TikTok's Terms of Service, Meta's Platform Terms, and Reddit's Data API Terms. You can revoke Tsuyu's access at any time from the relevant platform's security settings; revoking access will disable publishing through Tsuyu for that account.
Tsuyu is not responsible for, and does not control, the policies or decisions of third-party platforms, including their decisions to remove content, strike, demonetize, shadow-ban, or suspend your account on their services. Such actions are between you and the platform.
9. Acceptable Use
You agree not to use Tsuyu to create, store, publish, or transmit any of the following:
- Content that is illegal in the United States or in the jurisdiction where you or your audience is located.
- Child sexual abuse material (CSAM) or any content that sexualizes minors. Tsuyu has zero tolerance and will report CSAM to the National Center for Missing & Exploited Children and relevant authorities.
- Non-consensual intimate imagery, revenge porn, or sexual content involving any identifiable real person without their documented consent.
- Copyrighted or trademarked material that you do not have rights to use.
- Deepfakes, voice clones, or other synthetic depictions of real people without their consent โ including public figures, except in clearly labeled satire or commentary where permitted by law.
- Hate speech, harassment, threats, doxxing, stalking, or targeted abuse of individuals or protected groups.
- Content that promotes self-harm, terrorism, or real-world violence.
- Spam, bulk-generated low-value content, or coordinated inauthentic behavior designed to manipulate platform algorithms or users.
- Misleading health, medical, or financial claims; dangerous misinformation; or election or civic misinformation.
- Content designed to circumvent YouTube's, TikTok's, or Meta's monetization, community, or advertiser-friendly content guidelines โ including reused content schemes, view-count manipulation, and content intended to evade age-gating or disclosure requirements.
- Malware, phishing payloads, or any attempt to probe, scan, attack, or circumvent the security of the Service or its users.
You also agree not to: (a) resell, sublicense, or white-label the Service; (b) scrape, crawl, or systematically extract content or data from Tsuyu; (c) reverse-engineer or attempt to derive the source code or model weights underlying the Service; (d) use Tsuyu to train a competing AI system; or (e) exceed the rate limits or quotas of your plan through automation.
10. Intellectual Property
The Service, including the Tsuyu name and logo, the user interface, the underlying software, documentation, and all improvements and derivatives of the foregoing, is owned by Tsuyu and its licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written consent.
Feedback, suggestions, and feature requests you submit are non-confidential. By submitting them you grant Tsuyu a perpetual, irrevocable, royalty-free license to use them without compensation or attribution.
11. Termination
By you. You may cancel your subscription from the Settings page at any time, and you may close your account entirely by emailing [email protected]. Closing a paid account does not entitle you to a prorated refund except as described in Section 4.
By us. We may suspend or terminate your account, without refund, if we reasonably believe you have materially breached these Terms (including the Acceptable Use policy in Section 9), if your use exposes Tsuyu, its users, or a third party to legal or operational risk, or if we are required to do so by law.
Data after termination. After your account is closed or terminated, we will retain your generated videos and source material in a read-only state for 30 days so you can export them. After that 30-day window, your User Content and account data will be permanently deleted from our active systems, subject to limited retention in backups and as required by law.
Sections that by their nature should survive termination โ including Sections 5 (license grant as to content you leave published), 6, 9, 10, 12, 13, 14, 15, and 17 โ will survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TSUYU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR TRADE USAGE.
We do not guarantee uninterrupted or error-free operation. We target a best-effort monthly uptime of approximately 99%, but we do not offer a contractual uptime SLA unless separately agreed in writing. Video generation depends on third-party services (including Anthropic, OpenAI, ElevenLabs, Replicate, Cloudflare R2, Stripe, and Resend), any of which may experience outages, rate limits, or degradations that affect the Service.
AI-generated scripts, voices, captions, thumbnails, and translations may be inaccurate, biased, or unsuitable for your use case. You should review output before publishing.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TSUYU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA; OR THE COST OF SUBSTITUTE SERVICES โ ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL, AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TSUYU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Tsuyu and its officers, directors, employees, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content, including any third-party material you chose to use as source; (b) your violation of these Terms or any applicable law; (c) your violation of any third party's rights, including intellectual property, privacy, or publicity rights; and (d) your use of the Service to publish content that results in a claim against Tsuyu or a platform you integrated with.
Tsuyu reserves the right to assume the exclusive defense and control of any matter otherwise subject to your indemnification, at your expense. You agree to cooperate with our defense of such claims.
15. Governing Law and Disputes
Governing law. These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution. Before filing a claim, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute for at least thirty (30) days.
Binding arbitration. If the dispute is not resolved informally, you and Tsuyu agree to resolve it by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted by a single arbitrator in the English language. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. YOU AND TSUYU EACH AGREE TO BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Exceptions. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for infringement of intellectual property rights, or from bringing an individual claim in small-claims court.
30-day opt-out. You may opt out of the arbitration and class-action-waiver provisions by emailing [email protected] with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other provision.
16. Changes to Terms
We may update these Terms from time to time. For material changes โ such as changes to the fees, the refund policy, the Acceptable Use policy, or the dispute-resolution provisions โ we will provide at least thirty (30) days' advance notice by email to the address on your account and by posting a notice in the Service. Non-material changes (clarifications, typo fixes, updates to external links) may take effect immediately upon posting.
Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree, you should stop using the Service and cancel your subscription before the change takes effect.
